The Bombay High Court ordered to stoppage of razing the house of the relatives of the prime accused, Fahim Khan, in the Nagpur riot case. Although his two-storey house has been completely demolished Abdul Hafiz’s house has been saved after the court’s intervention on the NMC order.
The court order came after Mehrunissa, 69, the mother of Fahim Khan, filed a petition in the court. After which the Nagpur bench of the Bombay High Court ordered to stop the process, which is against the Supreme Court’s guidelines.
The violence erupted on 17th March in the Mahal area after some people allegedly burnt a “chaddar” and “Quran” and asked for the demolition of Aurangzeb’s tomb. The ring group was identified as the Vishwa Hindu Parishad and Bajrang Dal, which incited violence. In an event of horror, people started throwing stones at the police. After which, section 144 was imposed in the area.
The demolition notice was issued by NMC, which ordered the removal of the houses under the Maharashtra Regional and Town Planning Act. But the order has been challenged against the November 13, 2024 ruling by the Supreme Court where it has stated that a person’s house can not be demolished solely based on the fact that he is an accused in a case.
Justice Nitin Sambre and Vrushali Joshi have intervened to stop the ongoing demolition by the NMC granting some temporary relief to the accused and his family.s is a huge question of how the funds are been managed. While there has not been any update or answer from the ministry for this charge, it needs to invest in capacity building and strict management to address the drawbacks.
